57.998             Physicians Victims of Hacking

The Medical Society of the State of New York advocate for state and federal laws that protect patients’ and physicians’ ability to submit and be paid for claims when criminal activities result in temporary or permanent damage to electronic systems, limitations on physicians, and ability to conduct electronic transactions and in the event a system failure occurs. If claims cannot be executed, once the system is operational, physicians and other healthcare providers may resubmit claims, appeals, and other required paperwork for a period of time that is at least twice the length of time as the period of system failure.
